So what 'Crimen Contra Pacem' means?

 

The Latin term 'Crimen contra pacem' translates to 'crime against peace' and is the predecessor of the present-day crime of aggression. 

 

Historical background of crime against peace/crime of aggression

 

The concept of 'crime against peace' was first introduced in the Charter of the International Military Tribunal (IMT) at the Nuremberg Trials following World War II, which was set up to prosecute leaders of Nazi Germany for war crimes, crimes against peace, and crimes against humanity. The IMT defined crimes against peace as "planning, preparation, initiation, or waging of a war of aggression, or a war in violation of international treaties, agreements or assurances, or participation in a common plan or conspiracy for the accomplishment of any of the foregoing."

 

The 1946 Judgment of the International Military Tribunal in Nuremberg stipulated that “War is essentially an evil thing. Its consequences are not confined to the belligerent states alone but affect the whole world. To initiate a war of aggression, therefore, is not only an international crime; it is the supreme international crime differing only from other war crimes in that it contains within itself the accumulated evil of the whole.” (IMT Vol. 22, p. 427).

 

The philosophical basis for this is found in just war theory, which states that waging a war without an acceptable cause for self-defense is unjust.   

 

Why international justice is important?

 

By condemning aggression, we can work toward accountability. When pursued correctly, holding people accountable for heinous crimes not only acts as a powerful deterrent but is also critical for successful reconciliation and strengthening peace in post-conflict societies. When people go unpunished, it erodes the foundation of society and fuels distrust among communities and the State, hindering long-lasting peace.
